OSIM PERSONAL DATA PROTECTION POLICY

This OSIM Personal Data Protection Policy (“PDP Policy”) sets out how OSIM International Pte Ltd (Co. Reg. No. 198304191N) (“OSIM” or “us” or “we” or “our”) collects, uses and discloses your Personal Data.

Depending on your location, additional terms may apply to your use of our services. Please refer to the region-specific privacy notices listed below for more information:

If there is any conflict between this PDP Policy and a region-specific notice, the region-specific notice shall prevail to the extent of the conflict for users in that region.

PERSONAL DATA

In this PDP Policy, “Personal Data” refers to any data, whether true or not, about an individual who can be identified (a) from that data; or (b) from that data and other information to which we have or are likely to have access, including data in our records as may be updated from time to time.

Examples of such Personal Data include but not limited to:

  1. Identification and contact details (e.g. name, NRIC, passport number or other identification number, telephone number, mailing address, email address);
  2. Technical and usage information collected from your device and OSIM smart products (e.g. network data, device model, operating system, unique identifiers, usage logs, massage program usage, device motion);
  3. Audio data, when the Apps’ voice command feature is enabled: audio recordings of your voice that are recorded by your mobile device when the App is running in the foreground or the background;
  4. Account information and credentials (e.g. those used to register an account or to authenticate via third-party services such as Facebook);
  5. Health-related data, including personal sleep data from integrated services (e.g. Apple Health, Google Health Connect, HUAWEI Health Service) and data recorded by OSIM smart devices (e.g. weighing scales, massage chairs, blood pressure monitors).
  6. Any other information relating to any individuals which you have provided us in any forms you may have submitted, or via other forms of interaction with you
DEEMED CONSENT

By using this website or any of OSIM Mobile Applications (collectively referred to as the “App”), and subject to and in accordance with applicable law, you shall be deemed to have consented to our collecting, using and disclosing your Personal Data to OSIM’s related corporations, authorised service providers and relevant third parties:

  1. where in response to a request for your Personal Data in connection with identified purposes as stated below, you voluntarily provide such Personal Data to OSIM for such purpose(s);
  2. where the collection, use or disclosure of your Personal Data is reasonably necessary for the performance of a contract between you and OSIM or any other organisation entered into at your request, which may include recipients of your Personal Data not indicated in this Privacy Policy; or
  3. where we have brought to your attention our intention to collect, use or disclose your personal data for the purposes stated below, and you have not taken any action to opt out or otherwise withdraw consent to the use of such Personal Data.
COLLECTION OF PERSONAL DATA

Our primary purpose in collecting personal data is to provide you with a safe, smooth, efficient, and customized experience when you use this website or any of our mobile applications. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. We only collect personal data about you that we consider necessary for achieving this purpose.

Generally, OSIM collects Personal Data from you or from your authorised representatives (i.e. persons whom you have authorised, persons who have been validly identified as being you or your authorised representative pursuant to our then-current security procedures), from third parties, or from publicly available sources in the following ways:

  1. when you submit forms relating to or purchase or use any of our products or services;
  2. when you interact with our personnel, agents, sales representatives or customer service officers, including via telephone calls, SMS, mail, face-to-face meetings and emails;
  3. when you respond to our queries or you request that we contact you or be included in an email or other mailing list;
  4. when you respond to our surveys, promotions or other incentives;
  5. when we receive references from business partners and third parties, for example, where you have been referred by them;
  6. when you submit your Personal Data to us for any other reasons; and
  7. when you use our mobile applications or our website.

If you provide us with any Personal Data relating to a third party (e.g. information of your spouse, children, parents, and/or employees), by submitting such information to us, you represent to us that you have obtained the consent of the third party to provide us with their Personal Data for the respective purposes.

PURPOSES FOR COLLECTION, USAGE AND DISCLOSURE

OSIM collects, and may use and disclose your Personal Data for the following purposes (“Purposes”):

  1. To allow us to provide you access to products and services and any relevant customer support;
  2. managing the administrative and business operations of OSIM or any of its related corporations and complying with internal policies and procedures;
  3. facilitating business asset transactions (which may extend to any mergers, acquisitions or asset sales) involving OSIM or any of its related corporations;
  4. matching any Personal Data held which relates to you for any of the purposes listed herein;
  5. resolving complaints and handling requests and enquiries;
  6. preventing, detecting and investigating crime and analysing and managing commercial risks;
  7. providing media announcements and responses;
  8. monitoring or recording phone calls and customer-facing interactions for quality assurance, employee training and performance evaluation and identity verification purposes;
  9. organising promotional events;
  10. legal purposes (including but not limited to obtaining legal advice and dispute resolution);
  11. conducting investigations relating to disputes, billing or fraud;
  12. meeting or complying with any applicable rules, laws, regulations, codes of practice or guidelines issued by any legal or regulatory bodies which are binding on OSIM (including but not limited to responding to regulatory complaints, disclosing to regulatory bodies and conducting audit checks, due diligence and investigations); and
  13. purposes which are reasonably related to the aforesaid.

OSIM collects, and may use and disclose your Personal Data for the following purposes (“Purposes”):

  1. conducting market research and surveys to enable us to understand and determine customer preferences and demographics to develop special offers and marketing programmes in relation to our products and services, and to improve our service delivery and our customers’ experience at our touchpoints;
  2. providing additional products and services and benefits to you, including promotions, loyalty and reward programmes from OSIM;
  3. data analytics and research;
  4. matching Personal Data with other data collected for other purposes and from other sources (including third parties) in connection with the provision, marketing or offering of Products and Services by OSIM;
  5. leads generation and management for marketing OSIM's Products and Services;
  6. administering contests, competitions and marketing campaigns, and personalising your experience at OSIM’s touchpoints;
  7. communicating to you advertisements involving details of our Products and Services, special offers and rewards, either to our customers generally, or which we have identified may be of interest to you (including but not limited to upselling, cross selling and online marketing);
  8. organising promotional events;
  9. to store and use your personal data in the App for synchronisation with your OSIM smart device so that you can connect to it wirelessly using the App;
  10. to improve the App and OSIM’s other products and services;
  11. to transfer your personal data to our hosting servers whether located in Singapore and China, or elsewhere;
  12. without prejudice to the generality of the foregoing, the purposes described in the DATA PROCESSING FOR WELL-BEING MEASUREMENT FUNCTIONS section of this PDP Policy;
  13. purposes which are reasonably related to the aforesaid.

In relation to particular products and services or in your interactions with us, we may also have specifically notified you of other purposes for which we collect, use or disclose your Personal Data. If so, we will collect, use and disclose your Personal Data for these additional purposes as well, unless we have specifically notified you otherwise or if you choose to withdraw consent to the use of your Personal Data for such purposes. We shall seek your consent before using your personal data for a purpose which has not been notified to you (except permitted or authorised by law).

The above purposes may continue to apply even in situations where your relationship with us has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

DISCLOSURE OF PERSONAL DATA

OSIM will take reasonable steps to protect your Personal Data against unauthorised disclosure. Subject to the provisions of any applicable law, your Personal Data may be disclosed, for the purposes listed below (where applicable), to:

  1. OSIM’s business units, related corporations and employees to provide products and services to you, address your questions and requests in relation to your customer accounts, subscription and billing or order arrangements with us as well as our products and services, to activate, deactivate, install, maintain and operate our systems and/or services;
  2. companies providing services relating to insurance and consultancy to OSIM;
  3. agents, contractors or third party service providers who provide operational services to OSIM, such as courier services, telecommunications, information technology, payment, printing, billing, payroll, processing, technical services, training, market research, call centre, security or other services to OSIM;
  4. any business partner, investor, assignee or transferee (actual or prospective) to facilitate business asset transactions (which may extend to any merger, acquisition or asset sale) involving OSIM or any of its related corporations;
  5. vendors or third party service providers in connection with marketing promotions and services offered by OSIM;
  6. our professional advisers such as auditors and lawyers;
  7. relevant government regulators, statutory boards or authorities or law enforcement agencies to comply with any laws, rules, guidelines and regulations or schemes imposed by any governmental authority; and
  8. any other party to whom you authorise us to disclose your Personal Data to.

In addition, where permitted under the Act and subject to the provisions of any applicable law, your Personal Data may be disclosed, for the Additional Purposes, to OSIM’s agents or other third party service providers in connection with promotions and services offered by OSIM.

OSIM may disclose your Personal Data to OSIM’s related corporations for the purpose of allowing OSIM’s related corporations to collect, use, and disclose your Personal Data for all of the same purposes for which OSIM is allowed to collect, use, and disclose your Personal Data. OSIM’s related corporations include OSIM’s subsidiaries, holding companies, and the subsidiaries of all of OSIM’s holding companies up to OSIM’s ultimate holding company.

The above purposes may continue to apply even in situations where your relationship with us has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

DATA PROCESSING FOR WELL-BEING MEASUREMENT FUNCTIONS

The well-being measurement functions of this mobile application (including the Tension Check function) allow you to measure and analyze your well-being indicators using sensors embedded in OSIM products and/or camera-based physiological detection technologies, such as electrocardiogram (ECG), photoplethysmography (PPG), and remote photoplethysmography (rPPG), etc.

When you use these well-being measurement functions, OSIM will collect, use, disclose and otherwise process your personal data as described below:

  1. OSIM will keep records of your well-being measurement results. You may view your previous results on this mobile application when you are logged into your account.
  2. Depending on the function used, biometric and physiological data such as ECG data may be collected by your OSIM product and synchronized with this mobile application. Where camera-based physiological detection technologies (such as PPG and rPPG) are used, physiological signals are extracted via cloud processing.
  3. During each well-being measurement, health-related data such as heart rate, respiration rate, and other well-being indicators may be derived from the biometric or physiological data and stored by OSIM.
  4. Where camera-based physiological detection technologies (such as rPPG) are used, facial images or video frames are processed solely for the purpose of extracting physiological signals and are not stored as images or videos by OSIM.
  5. OSIM will collect and store the personal data that you voluntarily input into this mobile application for the purpose of well-being measurements, such as your gender, date of birth, height and weight.
  6. The biometric, physiological and health-related data collected during each use of the well-being measurement functions will be linked to a timestamp.
  7. The data collected by OSIM is stored on cloud servers located in Singapore and China, and maintained by OSIM’s third-party service provider, Amazon Web Services (AWS). Your data is encrypted during transit and while stored on the servers.
  8. OSIM uses the biometric data, derived health-related data and user-provided personal data to provide you with the well-being measurement functions of this App, and to support the enhancement, development and improvement of the App.

You have the right to refuse to give your consent for OSIM to collect, use or disclose your personal data. However, please note that if you do not provide or withdraw your consent for the processing of your personal data as described in this section, you will not be able to use the relevant well-being measurement functions of our products.

CONTACT VIA TELEPHONE NUMBER(S)

If you have provided your Singapore telephone number(s) to us and have indicated that you consent to receiving marketing and other promotional information, OSIM may contact you using such Singapore telephone number(s) (including via voice calls, SMS, fax or other means) with information about our products and services (including discounts and special offers) even if your Singapore telephone number(s) are registered with the Do Not Call Registry.

WITHDRAWAL, ACCESS AND CORRECTION

You may withdraw your consent to any of the aforementioned purposes at any time by emailing us at dpo@OSIM.com.sg.

You may also request for access to and/or correction of your Personal Data which OSIM has collected from you by contacting OSIM's Data Protection Officer at dpo@OSIM.com.sg.

Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal data where such collection, use and disclose without consent is permitted or required under applicable laws.

RETENTION

OSIM will retain your Personal Data for the duration of time to carry out the purposes for which your personal data was collected, for the other purposes set out in this policy, for business purposes and as required by relevant laws.

GOVERNING LAW AND JURISDICTION

This PDP Policy shall be governed by and construed in accordance with the laws of Singapore. The parties irrevocably agree to submit to the exclusive jurisdiction of the courts of Singapore as regards any claim or matter arising in relation to this Policy. The Contracts (Rights of Third Parties) Act 2001 shall not apply to the Policy.

UPDATES TO THE POLICY

OSIM reserves the right, at any time and without notice, to add to, change, update or modify this PDP Policy, simply by notifying you of such change, update or modification. Any such change, update or modification will be effective as stated in the PDP Policy.

SECURITY

OSIM operates secure data networks protected by industry standard firewall and password protection systems. Our security and privacy policies are periodically reviewed and enhanced as necessary and only authorized individuals have access to the information provided by our customers.

You acknowledge that you are aware of security and privacy limitations, including but not limited to:

  1. the limitation of security, privacy and authentication measures and features in our system;
  2. that data or information on the Service may be subject to eavesdropping, sniffing, spoofing, forgery, spamming, "impostering", tampering, breaking passwords, harassment, fraud, electronic trespassing, hacking, nuking, system contamination (including, without limitation, viruses, worms and Trojan horses) causing unauthorized, damaging or harmful access and/or retrieval of information and data on your computer;
  3. may be subject to other security or privacy hazards; or
  4. may not reach its destination or may reach an erroneous address or recipient.
PASSWORDS

A password is required to login to access our Website's member features. You are not to disclose your password to any third parties nor share it with any person/s not authorised to share this knowledge.

Aside from the unforeseen circumstance of unauthorised hacking into your computer systems, or theft of your own records, your password remains your sole responsibility. If you lose control of your password, it is highly likely that you will lose control of your access to our Web Site, and you may be subject to legally binding action (such as contracts entered into) made on your behalf.

If you suspect that your password has been compromised for any reason whatsoever, kindly let us know immediately, and make arrangements to change your password.

PERSONALLY IDENTIFIABLE INFORMATION

OSIM gathers the following types of information from users:

  1. Information that users provide through optional, voluntary submissions. These are voluntary submissions to register as members, to receive our electronic newsletters, to participate in our message boards or forums, to email a friend, and from participation in polls and surveys;
  2. Information OSIM gathers through aggregated tracking information derived mainly by tallying page views throughout our sites. This information allows us to better tailor our content to readers' needs by helping our advertisers and sponsors better understand the demographics of our audience

Following registration, you can review and change the personal particulars you submitted during registration. You must promptly update your information if it changes.

We will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes and troubleshoot problems. Further, such prior information is never completely removed from our databases due to technical constraints and the fact that we back up our systems. Therefore, you should not expect that all of your personally identifiable information would be completely removed from our databases in response to your requests.

USAGE TRACKING

OSIM tracks user traffic patterns throughout all of our sites in order to collect or analyse anonymised information from which individuals cannot be identified. OSIM does break down overall usage statistics according to a user's domain name, IP address, browser type and MIME type by reading this information from the browser string (information contained in every user's browser), but this information is never associated with individual users

OSIM sometimes tracks and catalogues the search terms that users enter in our Search Engine, but this tracking is never associated with individual users. We use tracking information to determine users' content preferences, based on traffic in those areas. We do not track what individual users read, but rather how well each page performs overall. This is necessary for the functioning of our services and to help us improve our service performance.

Without prejudice to the above consent granted, you agree and acknowledge that OSIM may collect usage statistics from your OSIM smart device with the App to evaluate the frequency of use for OSIM's product. Such usage statistics will automatically be sent from the OSIM smart device to the App. Such usage statistics will be transmitted to and stored in cloud servers for data processing purposes whenever you connect to the Internet. You further agree to the sending of any error logs generated by the App to OSIM to facilitate the development of future updates to the App.

COOKIES

"Cookies" are small text files stored on your computer. The cookie itself does not contain personal information, but contains information about your activity on our site to let us know whether you are a prior customer and to provide certain unique features to you. We do not use cookies to handle any financial information. The only personal information a cookie can contain is information you supply yourself.

A cookie cannot read data off your hard disk or read cookie files created by other sites. OSIM uses cookies to track user traffic patterns. You can refuse cookies by turning them off in your browser. If you have set your browser to warn you before accepting cookies, you will receive the warning message with each cookie.

This site requires you to have enabled cookies on your browser in order to tailor the shopping experience and to store information such as a shopping cart.

Cookies can be disabled or removed by tools that are available in most commercial browsers. The preferences for each browser you use will need to be set separately and different browsers offer different functionality and options.

THIRD-PARTY PROVIDERS AND SERVICES

OSIM may receive personal data from third-party providers and services granted with your permission. OSIM cannot control the privacy practices and data protection policies of third parties. For this reason, OSIM cannot be held responsible for breach of security by third parties and we encourage you to learn about their privacy practices of those third parties.

ACCOUNT AND DATA DELETION

You can delete your OSIM Well-Being app account and your personal data via: OSIM Well-Being App → “Profile” tab on the bottom right corner → “Account Settings” → “Delete My Account”. After you have deleted your OSIM Well-Being app account, you will not be able to log in and use OSIM Well-Being app and/or its services. Your personal data and records in your account will be deleted. You will not be able to retrieve the items you have downloaded before. If you would like to delete your personal data while keeping your OSIM Well-Being app account, please contact OSIM's Data Protection Officer at dpo@OSIM.com.sg.

PERSONAL DATA OF CHILDREN

OSIM does not knowingly collect personal data from children under 13, or equivalent minimum age depending on jurisdiction. If you become aware that a child has provided us with personal data without parental consent, please contact us at dpo@OSIM.com.sg.

If we learn that we have collected the personal information of a child under 13, or equivalent minimum age depending on jurisdiction, without parental consent, we will take steps to delete the information as soon as practicable.

ACCESS AND CORRECTION

If you wish to update your personal data stored in the App, you may do so by accessing your profile in the App. You may also request in writing for access to and/or correction of your personal data which OSIM has collected from you. Please contact OSIM's Data Protection Officer at dpo@OSIM.com.sg if you have any questions in this regard.

TRANSFER

In the event that OSIM needs to transfer your personal data out of Singapore, OSIM will take steps to ensure that the recipient organisation is bound by legally enforceable obligations to accord the same standard of protection to the transferred personal data as it would enjoy under Singapore data protection laws.
